Belarus' Constitutional Court checks validity of 102 parliament acts in 2008

Chairman of the Constitutional Court of Belarus Piotr Miklashevich presented a report to President of Belarus Alexander Lukashenko on the work of the Constitutional Court in 2008, BelTA learnt from the presidential press service.

The Constitutional court secures the supremacy of the Constitution and its direct application on the territory of the state, the protection of rights and freedoms of the Belarusian citizens. In 2008, the court delivered more than 20 decisions resolving discrepancies and contradictions in the country's legislation. These decisions contain the proposals on how the parliament and the government can eliminate the flaws in the existing normative acts.

In 2008, the Constitutional Court checked the constitutionality of 102 laws adopted by the House of Representatives and affirmed by the Council of Republic. The checks revealed no contraventions of the Constitution. At the same time, the Constitutional Court fine-tuned some normative acts to ensure their constitutionality.

The Belarusian head of state praised the work of the Constitutional Court on the implementation of Decree No 14 which gives the Court additional authority. The amendments to the national legislation therefore are not on the agenda yet. Later, after the approbation and practical application of the Decree, the relevant amendments to the Code on the Judicature and the Status of Judges can be developed.

The preliminary constitutional control of laws carried out by the Constitutional Court of Belarus has been introduced among the Post-Soviet countries for the first time. The combination of preliminary and subsequent constitutional control makes it more efficient and keeps up with the present-day global trends of the constitutional justice.

Alexander Lukashenko focused on the necessity to fully use the additional authority delegated to the Court, in particular, in order to encourage the relevant state agencies to submit requests to the Constitutional Court to check the validity of normative and legal acts.

According to the President, it would be useful to raise the educational role of the judicial system, including through the mass media.
